The MBA can also be utilized as a consumer resource if problems arise. We have long offered mediation and arbitration services to members and homeowners in an effort to resolve construction-related disputes before they reach the courtroom. MBA members all agree to binding arbitration, which gives home buyers some recourse if a dispute arises during the construction process. “The process of building or remodeling is more complex than most other buyer-seller transactions,” explains Siewert. “Even the best-written contract, site plan and specifications can leave room for legitimate interpretational differences.”
